Welcome to The Guardians of Onigel. By accessing and using this website, you agree to comply with the following terms and conditions. We recommend that you read them carefully before making any purchase.
1. General Information
This website is operated by The Guardians of Onigel. By browsing the site and/or making a purchase, you are using our “Services” and agree to the terms described herein.
2. Products and Personalisation
Our products include children’s wall decals, personalised storybooks, and other related items.
Personalised storybooks and decals are created based on the information provided by the customer (e.g. the child’s name). The customer is responsible for reviewing and confirming that all entered data is correct.
Due to their personalised nature, these products are subject to specific legal conditions regarding returns.
3. Right of Withdrawal (Returns)
In accordance with Decree-Law No. 24/2014 of 14 February, consumers have the right to withdraw from a distance contract (such as online purchases) within 14 calendar days from receipt of the goods, without giving any reason (Articles 10 and 11).
The seller must reimburse all amounts paid, including standard delivery costs, except for any additional costs resulting from the choice of a delivery method other than the standard option (Article 12).
4. Exceptions to the Right of Withdrawal
According to Article 17(c) of Decree-Law No. 24/2014, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised.
This means that:
Personalised products (such as named storybooks or custom-made decals) cannot be returned or cancelled once production has started due to a change of mind.
Returns will be accepted in the event of a manufacturing defect or an error attributable to us.
5. Non-Personalised Products
For standard, non-personalised products, the right of withdrawal remains valid under the terms of Decree-Law No. 24/2014 and may be exercised within the aforementioned 14-day period.
Products must be returned in perfect condition, unused, and in their original packaging.
Return shipping costs are borne by the consumer unless otherwise stated.
6. Warranties and Non-Conforming Goods
Under Decree-Law No. 84/2021 of 18 October, consumers are entitled to goods that conform to the contract.
If the delivered product is defective, damaged, or does not match what was agreed, the consumer may request repair, replacement, an appropriate price reduction, or contract termination.
The applicable timeframes and conditions follow current Portuguese legislation.
7. Prices and Payments
All prices are shown in euros (€) and include applicable taxes unless otherwise stated.
We accept various payment methods available on the website at the time of purchase.
Payment must be completed in full before the order is processed.
8. Shipping
We ship to Portugal and other European Union countries. Delivery times and costs depend on the destination and are provided during the checkout process.
We are not responsible for delays caused by courier services or force majeure events.
9. Intellectual Property
All website content, including texts, illustrations, designs, and characters, is the property of The Guardians of Onigel and is protected by copyright law.
Use, reproduction, or distribution without express authorisation is prohibited.
10. Use of the Website
The customer agrees not to use the website for illegal, fraudulent activities or actions that may affect its proper functioning.
We reserve the right to limit or cancel orders if we detect a breach of these terms.
11. Modifications
We reserve the right to update or modify these Terms and Conditions at any time. The latest version will always be available on this page.
12. Applicable Law and Jurisdiction
These terms are governed by Portuguese law, in particular:
Decree-Law No. 24/2014 of 14 February (distance contracts and right of withdrawal).
Decree-Law No. 84/2021 of 18 October (consumer rights and guarantees).
In the event of a dispute, both parties submit to the competent courts of the consumer’s place of residence.
